Intellectual property

Search the prior art. Draft the claims.

Search the patent database from the invention disclosure, draft the claims, and answer the examination notice. The disclosure never leaves the firm.

The invention, read against what is already published.

The papers

  • Prior art
  • Specification
  • Claims
  • Examination notice
  • Trade mark examination report
  • Opposition

Through an IP file.

01

Prior art search

The invention disclosure is read and the claim elements are extracted.

Different combinations of keywords are generated from those elements and used to search the patent database. The results are then filtered to the documents that actually disclose one or more of the claim elements. Each relevant document is returned with the specific passages that match.

02

The specification and the claims

The specification and the claims are drafted from the invention disclosure and the firm’s form.

Each claim element is checked against the description. Any element that is not supported, or a description that does not enable the claim, is flagged before the draft is presented for review.

03

Response to the examination notice

Each rejection in the examination notice is mapped to the claim element it attacks and the prior art the examiner cited.

The system identifies the differences between the claim and the cited art, and places the proposed amendment next to the rejection. Any rejection that remains unanswered stays open for the lawyer to address.

04

Trade mark examination report

The applied-for mark is compared with the earlier marks cited in the examination report, and the goods or services are compared with those of the cited marks.

The points of similarity and difference are set out. The response is then drafted in the firm’s form, ready for review.

05

Opposition

The notice of opposition and the evidence on the file are read.

Each ground of opposition is identified and addressed in the counter-statement. The ground is admitted or denied, and the facts from the evidence that are relied on are set out under it. The draft follows the firm’s form.

On this work, the same rules.

Private and Local

It can run inside the firm, with no connection out. We never see the files, and a model provider never does. There is no outside copy to keep or to train on.

Only who needs it

Access is limited by person, by matter, and by practice. The admin sets each role. Every action is logged, and can be traced.

Your way of working

It follows your past matters, your wording, and your playbook. A review looks for what your team already treats as important.

Edits you can see

The change is made in the file you already have. Layout and numbering stay. You get track changes, and each answer points to its source.

Ready on day one

Jurisdiction-specific material is already there, from legislation, government, and regulators. So are skills for this kind of work.

Questions

What if a claim element is invented?
A claim element that is not supported by the description is flagged. A description that does not enable the claim is flagged. The lawyer still decides what is filed.
Does the invention disclosure leave the firm?
No. The system runs on the firm’s machines. Makebell cannot see the documents, and the model provider cannot see them. There is no data to train on. Pasting an invention into a public model can be treated as a public disclosure that destroys novelty.
Does Makebell train on our patent files?
No. The system runs on the firm’s machines. Makebell cannot see the documents, and the model provider cannot see them. There is no data to train on.
Who has access to a patent’s files?
Only the people the firm gives access to. Documents are separated by person, by matter, and by practice. The firm’s administrator sets the rights. Every action is written to an audit log. Makebell cannot open the files.
Does it file the patent or the trade mark?
No. It prepares the search, the draft, the response, and the counter-statement. The lawyer files.
What if we do not have the hardware?
What you need depends on the size of the team and on how the system will be used. Talk to us. We will assess that and recommend what to buy, or what to lease.
